Mochtar Kusumaatmadja (1929-2021)

O Instituto Brasileiro de Direito do Mar (IBDMAR) lamenta profundamente o falecimento do Professor Mochtar Kusumaatmadja, ocorrido em 6 de junho de 2021. Seu nome talvez ainda não seja tão citado nos manuais sobre Direito do Mar à altura de sua enorme contribuição para o desenvolvimento do campo.

O Professor Kusumaatmadja foi uma figura política distinta na Indonésia pós-independência (1945). Logo após a independência, havia a dúvida se os recursos naturais da área entre essas formações pertenciam à Indonésia, assim como se haveria o direito das outras nações de cruzarem aquelas águas por dentro do território indonésio. Diante disso, o Professor Kusumaatmadja teve a ideia de uma declaração unilateral, conhecida como Declaração de Djuanda, que se tornou um símbolo pelo reconhecimento do regime jurídico dos Estados Arquipelágicos na Conferência das Nações Unidas sobre Direito do Mar.

Com grande pesar, reconhecendo sua importância para o desenvolvimento do Direito do Mar e dos direitos dos Estados Arquipelágicos, o IBDMAR presta condolências a familiares e amigos.

The Brazilian Institute for the Law of the Sea (BILOS) deeply regrets the death of Professor Mochtar Kusumaatmadja, which sadly occurred on 6 June 2021. His name may not be quoted in the Law of the Sea literature with the due reverence to the contributions that he gave to the field.

Professor Kusumaatmadja was a distinguished political figure during post-independent Indonesia (1945) times. Soon after its independence, there were doubts whether the natural resources within the area between the features which constituted the country belonged to Indonesia, as well as whether other nations would have the right to cross those waters within that territory. At that, Professor Kusumaatmadja came up with the idea of a unilateral declaration, known as the Djuanda Declaration, which became a symbol for the recognition of the Archipelagic States legal regime in the United Nations Conference on the Law of the Sea.

With grief, and recognizing his importance for the development of the Law of the Sea, BILOS offers its condolences to family and friends.
